1. Agreement to these terms
This website is operated by IdeaWeb Technologies Limited, a charitable organisation registered in New Zealand (registration number CC61994). By using this site you agree to these terms. If you do not agree to them, please do not use the site.
We may change these terms from time to time. The current version is always on this page. Continuing to use the site after a change means you accept the revised terms.
2. Using the site
You may read, search and share our content for your own personal, non-commercial use. You must not use the site in any way that is unlawful, that interferes with its operation, or that restricts anyone else’s use of it.
3. Our content
All content on this site — articles, photographs, video, audio, graphics, layout and code — is owned by us or used under licence, and is protected by copyright.
You may:
- link to our pages;
- quote a short extract of an article, provided you attribute it to The Newsly Times and link to the original.
You may not, without our written permission:
- republish, syndicate or redistribute our content, in whole or in substantial part;
- use our content for a commercial purpose;
- copy, download or scrape our content in bulk, whether manually or by automated means; or
- use our content to train, fine-tune or evaluate an artificial intelligence or machine learning system.
Some content on this site is supplied by news agencies and other licensors and is credited accordingly. That content is subject to the licensor’s own terms, and permission to reuse it must come from them, not from us.
4. Video and audio
Some of our journalism is published as video or audio. This material is hosted on YouTube and embedded in our pages, and may also appear on our YouTube channel at [link]. Playback is provided by YouTube, and your use of the player is also subject to YouTube’s own terms of service.
Our video and audio is our content for the purposes of clause 3. You may watch it and share it using the sharing controls YouTube provides. You may not download it, re-upload it to another account or platform, edit it, or use it in your own production without our written permission.
Where we embed video or audio published by someone else, it belongs to whoever published it, and any permission to reuse it must come from them, not from us.
5. Material you send us
When you send us material for publication — including a letter, comment, photograph, obituary notice, listing or news tip — you confirm that:
- the information in it is true and accurate as far as you know;
- you own it or have the right to give it to us for publication;
- you have the consent of anyone identifiable in it, and, for an obituary, the agreement of the immediate family; and
- it is not defamatory, offensive, misleading, or in breach of anyone’s rights.
You keep ownership of what you send us. By sending it, you give us a non-exclusive, royalty-free, worldwide licence to publish, edit, translate into English or Malayalam, broadcast, reproduce and archive it in any medium, and to allow others to share it through normal social sharing. This licence continues for the material we have published, so that our archive stays intact.
We are not obliged to publish anything you send us, we may edit it, and we may remove it. Unless we have agreed otherwise in writing, no payment is made for material sent to us.
6. Obituary notices
We publish obituary and funeral notices as a service to our communities. We may contact you to verify a notice before publishing, and we may decline to publish a notice we cannot verify. Publishing a false death notice is a serious matter and may be a criminal offence; we will report attempts to do so.
A notice published in error, will be removed promptly on request from the immediate family.
7. Matrimonial listings, job advertisements and classifieds
These sections are a noticeboard. We are not a party to any arrangement made through them, we do not check the accuracy of listings, and we do not vet the people who place or respond to them.
Please take the same care you would with any other stranger: do not send money, identity documents or financial details to someone you have not met, be cautious about meeting alone, and tell someone where you are going. If you believe a listing is a scam, tell us and we will remove it.
We accept no responsibility for any loss arising from a listing or from any dealing between users, except to the extent the law does not allow us to exclude it.
8. Things you must not do
You must not use this site to:
- post or send anything unlawful, defamatory, threatening, harassing, obscene, hateful, or which incites violence;
- post anything that breaches a court order, including a suppression order;
- impersonate another person or misrepresent your connection with anyone;
- post material that infringes copyright or another person’s rights;
- collect other users’ personal information;
- introduce malicious code, attempt to gain unauthorised access, or test the security of the site; or
- use automated systems to access the site in a way that places an unreasonable load on it.
Conduct of this kind may also breach the Harmful Digital Communications Act 2015 or other New Zealand law.
9. Comments and community discussion
Where comments are enabled, they are moderated. We may decline, edit or remove any comment, and we may block a user, without giving reasons. Comments express the views of the people who post them, not ours.
10. Accuracy, and no professional advice
We take care to publish accurate information and we correct errors — see our Corrections Policy. News reporting is produced to deadlines and on the basis of information available at the time, and we do not warrant that everything on the site is complete or current.
Nothing on this site is legal, financial, medical, immigration or other professional advice. Content about health, money, immigration, employment or legal matters is general information only. Please consult a qualified professional about your own situation.
11. Advertising and sponsored content
Advertising and sponsored content help fund our charitable activity. Advertising is identified as such, and sponsored or paid content is clearly labelled. Advertising has no influence on our journalism — see our Editorial Policy.
We do not endorse advertisers or their products, and we are not responsible for their goods, services or claims. Any dealing with an advertiser is between you and them.
12. Links to other websites
We link to other sites for your convenience. We do not control them and are not responsible for their content, accuracy or privacy practices.
13. Availability of the site
We aim to keep the site available but do not guarantee uninterrupted access. We may suspend, withdraw or change any part of the site, including any section or service, at any time.
14. Our liability
If you are using this site for the purposes of a business, the Consumer Guarantees Act 1993 does not apply. Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.
Subject to that, we are not liable for any indirect or consequential loss, loss of profit, loss of data, or loss arising from your reliance on content published on the site, from any dealing with an advertiser or another user, or from the site being unavailable. Where liability cannot be excluded, our total liability is limited to [NZ$100 / the amount you have paid us in the previous twelve months].
15. Your responsibility to us
If you breach these terms and that causes us loss — for example a claim arising from material you sent us for publication — you agree to reimburse us for the reasonable costs and damages that result.
16. Suspending access
We may restrict or withdraw your access to the site, or to any service on it, if you breach these terms.
17. Privacy
Our Privacy Policy explains how we handle personal information and forms part of these terms.
18. General
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If any part of these terms is found to be unenforceable, the rest continues to apply. A delay in enforcing these terms is not a waiver of our rights.
